For a long time, Kant’s Doctrine of Right languished in relative neglect, even among Kantians. The work was best known for its uncompromising views on punishment and revolution, and for a seemingly limited and not particularly original emphasis on private property. Kant’s more interesting political claims were often said to be located elsewhere: in the third Critique (Hannah Arendt, Patrick Riley), or the structure of the critical project (Onora O’Neill). When John Rawls explained why his theory of justice (...) could be given a ‘Kantian interpretation’, he drew on concepts found just in Kant’s moral philosophy, bypassing the Doctrine of Right entirely. -/- In recent years, however, there has been an expanding body of work on the Doctrine of Right, by writers like B. Sharon Byrd and Joachim Hruschka, Arthur Ripstein, Elisabeth Ellis, and Lea Ypi. Ripstein and Ellis, in particular, have sought to reframe the arguments of Kant’s text in terms more congenial to contemporary legal and political theory. But can Kant’s arguments really be applied to twenty-first-century political debates? -/- The authors in this collection of essays explore this question in different ways, by looking at different aspects of Kant’s text. What is distinctive about Kant’s conception of the social contract, or human rights? Can a Kantian political philosophy concern itself with poverty and welfare rights? Can a Kantian affirm a conception of civil disobedience? What kind of view should a Kantian have of international relations? Can Kant’s views on punishment be reconciled with a conception of forgiveness? Competitive negotiators frequently use tactics which others view as "unethical", in that these tactics either violate standards of truth telling or violate the perceived rules of negotiation. This paper sought to determine how business students viewed a number of marginally ethical negotiating tactics, and to determine the underlying factor structure of these tactics. The factor analysis of these tactics revealed five clear factors which were highly similar across the two samples, and which parallel (to a moderate degree) categories of tactics (...) proposed by earlier theory. Data from one sample also permitted comparisons of the appropriateness of certain tactics across gender, nationality, ethnic origin and perception of one's negotiating style. (shrink)

We are reviewing and summarizing evidence for the processes of acquisition of information outside of conscious awareness (processing information about covariations, nonconscious indirect and interactive inferences, self-perpetuation of procedural knowledge). A considerable amount of data indicates that as compared to consciously controlled cognition, the nonconscious information-acquisition processes are not only much faster but also structurally more sophisticated in the sense that they are capable of efficient processing of multidimensional and interactive relations between variables. Those mechanisms of nonconscious acquisition of information (...) provide a major channel for the development of procedural knowledge which is indispensable for such important aspects of cognitive functioning as encoding and interpretation of stimuli and the triggering emotional reactions. L’educazione teatrale, parlando in linea generale, storicamente viene riconosciuta come madre dell’educazione alla comunicazione. L’articolo nella prima parte percorre le diverse forme dell’educazione teatrale del XX secolo, sottolineando le conquiste del movimento della scuola di teatro, conosciuta sotto i nomi di ‘drama education’, dell’animazione teatrale o del teatro educativo. L’educazione teatrale è entrata anche nei curricoli delle scuole di comunicazione. Le scienze del teatro possiedono la loro storia, che dimostra il lento, ma necessario distacco dagli studi di letteratura verso l’approccio (...) interdisciplinare di teatrologia, di scienze dello spettacolo e/o dei performance studies presenti nel mondo universitario occidentale. Lo sviluppo degli studi sul teatro ha dato impulso alla semiotica, scienza par excellence di comunicazione, e la matrice teatro-spettacolare, nell’opinione dell’Autore, sta alla base degli studi teorici sui diversi generi di comunicazione mediatica. La presenza, dunque, delle scienze del teatro nel curriculum della Facoltà di Scienze della comunicazione è giustificata, necessaria ed arricchente, sia dal punto di vista accademico, sia dalla com-partecipazione degli studenti al processo creativo e comunicativo della rappresentazione teatrale vista in tante sue funzioni socio-culturali. The essay broadens the understanding of Ortega's thought by elaborating his historiosophy, which is crucial to fully comprehend his popular work, 'The Revolt of the Masses'. The author argues that Ortega's famous sociological framework (based on the interplay between the elites and the masses) is very often trivialized due to the lack of knowledge about his anthropological assumptions, upon which the model of the evolution of culture is constructed. Utilizing the already existing literature (inter alia a synthetic work by K. (...) Polit), the essay reconstructs three philosophical crises in European thought that can be ultimately depicted as a suggestive sinusoid of social attitudes operating throughout the history of Western Civilization between the two boundary lines of the primary 'belief'. The belief is in fact a trust in the first data people have to adopt before they start to think philosophically: the priority of the object or the subject (historically: fides or ratio). The sinusoid shows the cyclical change of the first data people tended to accept and reveals a certain cultural mechanism: every culture is first developed by the inspired generation of individuals who structure reality in some way and then fight for the dissemination of their framework. After they prevail and the culture is accepted on a mass level, a process of degradation starts - this is because the culture gradually looses its link with the vivid circumstances that once constituted the stimulus for the founding generation. As a result, the culture becomes gradually more formal and distant from 'real life' - the elites do not innovate anymore, perceiving their world view as well-established and the masses are able only to renovate what is inherited. In the long run this leads to 'vital disorientation', which must force the next great generation of individuals to structure reality anew. 'The Revolt...' perceived in this way receives another layer of understanding. The popular interpretation of the book is that mass men, knowing their inherent rights (thanks to democracy) and having leisure time (technological advance) enter the public stage and want to be ruled by somebody of their sort. The author highlights that, apart from these two, a third factor is present: the long-term socialization of the culture of 'pure rationalism'. The mass man already feels that it does not correspond fully to his daily experience and becomes disoriented as a result. In consequence, the time of mass movements has come (that will be organized in accordance with the radicalized principle of either rationalism or irrationalism), until the elites harness the revolted masses again. The final part of the essay suggests the possible Eastern European dimension of Ortega's predictions about postmodern Europe and indicates that his intuitions were sufficiently accurate to foresee the emergence of some main currents in the contemporary humanities and sciences. Les problèmes touchant la doctrine d’Alcher de Clairvaux sur Dieu, n’ont étéstraites jusqu’à présent par aucun des auteurs qui s’interéssaient aux idées d’Alcher. Et cependant ces problèmes occupent une place importante dans l’oeuvre de Alcher et laissent voir de nombreux emprunts à Anselme de Cantorbery, à Gennadius de Marseille, à Béde le Vénérable et à un écrit pseudo-ambrosien, intitulé De dignitate conditionis humanae. — II faut signaler tout spécialement les emprunts dûs a Anselme, qui n’ont pas été signalés par les (...) auteurs informant dans certaine manuels et encyclopédies des influences que subissait Alcher. C’est d’Anselme qu’il prit la doctrine typiquement augustinienne que l'introspection mène leplus sûrement à la connaissance de Dieu, et que l'on trouve Dieu quand on penetre avec recueillement à l'intérieur de l'âme, avide de Dieu. C’est aussi on imitant Anselme qu’Alcher accentua tout particulièrement la bonté de Dieu, on soulignet son rapport aux autres perfections divines. II faut cependant remarquer que l’innfluence d’Anselme ne se borne pas à la transmission des idées augustiniennes, mais eile fit qu’Alcher adopt a aussi les conceptions propres à Anselme. On retrouve chez Alcher la formule purement anselmienne, parlant de Dieu comme d’un être si parfait, qu’il n’y on a pas de plus grand: ens quo nihil maius (melius) cogitari potest. — Alcher completa sa conception de Dieu, l’Etre enfermant toute perfection, par des énonciations d’autres au sujet de quelques perfectione divines. A cet égard l’écrit de Gennadius de Marseille De ecclesiaticis dogmatibus fut pour Alcher une source très importante. Alcher en a prie l'idée de l'incorporeite et de l'omniprésence, et aussi celles des relations réciproques entre ces daux perfections Conformément à Gennadius, il comprit l'incorporéité comme surpassant les bornes du temps et de l'espace, done comme condition directe de l'omniprésence. Cette façon de comprendre l'omniprésence divine entraine à son tour l’affirmation que l'incorporéité comme telle est propre é Dieu seul. — Alcher approfondit tout spécialement cette question, on complétant les énonciations de Gennadius par celles de Bède. Les textes de Bede assimilés par Alcher par lent d’une particulière présence de Dieu dans l’homme. Dieu, demeurant dans l'âme humaine, la remplit de son essence et cette présence est toute autre que celle arttribuée aux etres crées. En outre des attributs cités, Alcher s’est tout spécialement interesse au problème du rapport de Dieu avec les créatures et surtout l’homme. Pour le mésoudre, Anselme se basa sur un écrit pseudo-ambrosien De dignitate conditionis humanae. Les emprunts qu’il y fait concernett surtout la dependance dans l’être entre Dieu et ses créatures, ainsi que les conséquences qui on découlent. Conformément à la conception du Pseudo-Ambroise, Alcher avant tout met à part l’homme des autres créatures, puisque l’homme porte en soi l’image de Dieu et Lui ressemble. Cependant on n’a pas réussi à déceler d’immédiats emprunts à la doctrine de Boèce, quoique Alcher connût certainement le De consolatione philosophiae, source des informations philosophiques sur Dieu, riche et très répandue au XII sièce. L’influence de Boèce sur Alcher est plutöt indirecte, moyannant les textes empruntés aux autres auteurs, et en principe se rapporte aux problèmes touchant la doctrine sur l'âme. (shrink)

La présente communication signale que les textes philosophiques contenus dans les sermons de St. Bernard sur le Cantique des Cantiques n’ont pas encore reçu, dans les études médiévistiques, l’attention qu’ils méritent. Ces textes apportent la preuve que les contacts de St. Bernard avec les problèmes philosophiques ne se bornent pas à la théorie de la connaissance mystique. L’intéresse aussi, p. ex. la typologie des êtres considerée au plan purement naturel. Le saint consacre une attention particulière aux êtres incorporels qu’il groupe (...) en une hiérarchie à quatre degrés. A l'échelon le plus bas de celle-ci, les âmes animales dépendent de la sphère corporelle quant à leur existence et leur activité de principes vitaux et remplissent, en même temps, une fonction auxiliaire par rapport aux êtres doués de raison. Les âmes humaines, eiles, en tant que spirituelles et raisonnables existent indépendamment des corps mais en dépendent dans leur activité, en particulier s’il s’agit de la connaissance, et ce non seulement des êtres matériels mais encore des spirituels. Ce climat d’ à posteriori transparait jusque dans les considérations sur les purs esprits qui, en tant que restreints en leur activité à un lieu déterminé, deviennent ainsi indirectement dépendants du rnonde corporel. Seul l’être du type le plus élevé, qu’est l’Esprit Incréé, est absolument iliimité, possédant sa raison d’être en lui-même; cause créatrice des autres êtres, II en conditionne Pexistence (U est Vesse causale) sans se confondre pourtant avec leur nature et conservant sa transcendance propre (II n’est pas esse materiale). II semble done qu’il y aurait lieu de completer, voire de modifier sur certains points, ce qu’enseignent les manuels sur les idées philosophiques de I’Abbé de Clairvaux. (shrink)

Arrhenius and Rabinowicz have argued that Millian qualitative superiorities are possible without assuming that any pleasure, or type of pleasure, is infinitely superior to another. But AR's analysis is fatally flawed in the context of ethical hedonism, where the assumption in question is necessary and sufficient for Millian qualitative superiorities. Marginalist analysis of the sort pressed by AR continues to have a valid role to play within any plausible version of hedonism, provided the fundamental incoherence that infects AR's use of (...) such analysis is removed. But what AR call ‘Millian superiorities’ are never genuine qualitative superiorities in Mill's sense. Mill scholars need to appreciate this point and recognize that the interpretation of qualitative superiorities as infinite superiorities is the only interpretation which is compatible with the text of Mill's Utilitarianism. The continuing failure to appreciate the possibility of infinite superiorities has precluded any adequate understanding of the extraordinary structure of Mill's pluralistic hedonistic utilitarianism. The correspondence between Hannah Arendt and Karl Jaspers begins in 1926, when the twenty-year-old Arendt studied philosophy with Jaspers in Heidelberg. Geoffrey Scarre has recently argued that the version of qualitative hedonism which I attribute to Mill is unsatisfactory for various reasons. In his view, even if it is formally compatible with value monism, involves non-hedonistic elements and offers an implausible account of the relationship between and pleasures. In this paper, I show that his objections, which are similar in spirit to those pressed earlier by Bradley, Moore and others against Mill, are unfounded where not confused. The Mill/Riley line does (...) not rely on non-hedonistic standards and has sufficient flexibility to account for many different kinds of pleasures and pleasing activities. It remains a coherent version of qualitative hedonism, worthy of further consideration and study. (shrink)

Against Schmidt-Petri's claim, I argue that John Stuart Mill is committed to the view that one pleasure is higher in quality than another if and only if at least a majority of those people who are competently acquainted with both always prefer the one no matter how much of the other is offered. I support my reading with solid textual evidence; none such is provided by Schmidt-Petri in support of his contrary interpretation that qualitative superiority exists whenever the experienced prefer (...) less of one pleasure to more of another. The decisive objection to this is its incompatibility with the hedonistic requirement that more pleasure ought to be preferred to less, a requirement so fundamental that it would be uncharitable to suppose that Mill lost sight of it in his doctrine of higher pleasures. In some areas of cognitive science we are confronted with ultrafast cognition, exquisite context sensitivity, and scale-free variation in measured cognitive activities. To move forward, we suggest a need to embrace this complexity, equipping cognitive science with tools and concepts used in the study of complex dynamical systems. The science of movement coordination has benefited already from this change, successfully circumventing analogous paradoxes by treating human activities as phenomena of self-organization. Therein, action and cognition are seen to be emergent in (...) ultrafast symmetry breaking across the brain and body; exquisitely constituted of the otherwise trivial details of history, context, and environment; and exhibiting the characteristic scale-free signature of self-organization. Mill's free speech doctrine is distinct from, yet compatible with, his central principle of ‘purely self-regarding’ liberty. Using the crucial analogy with trade, I claim that he defends a broad laissez-faire policy for expression, even though expression is ‘social’ or other-regarding conduct and thus legitimately subject to social regulation. An expedient laissez-faire policy admits of exceptions because speakers can sometimes cause such severe damage to others that coercive interference with the speech is justified. In those relatively few contexts where interference (...) is called for, however, the central principle of self-regarding liberty sets absolute limits to the scope of society's regulatory authority. Regulation can never amount to an outright ban of any type of expression that can be consumed by the individual without direct and immediate harm to others. Nevertheless, and perhaps surprisingly, the central liberty principle admits censorship of certain extraordinary types of expression which necessarily harm others. (shrink)

Hannah More (1745–1833) was a White English poet, playwright, educator, and abolitionist. This chapter is an excerpt from her famous antislavery poem Slavery, A Poem, which she published in 1788. The poem describes liberty as a light originating in heaven and asks why this light shines on only some portions of the earth; More invokes optical laws to illustrate how unnatural it is to view liberty as appropriate for only some human beings. In the last two stanzas, which are (...) also reproduced here, she provides philosophical arguments for racial equality and the injustice of slavery. When arguing for equality, she stresses that Black and White people are the same in both intelligence and affections or feelings. (shrink)

German philosopher Martin Heidegger stirred educators when in 1951 he claimed teaching is more difficult than learning because teachers must ‘learn to let learn’. However in the main he left the aphorism unexplained as part of a brief four-paragraph, less than two-page set of observations concerning the relationship of teaching to learning; and concluded at the end of those observations that to become a teacher is an ‘exalted matter’. This paper investigates both of Heidegger's claims, interpreting letting learn in the (...) context of Heidegger's larger philosophical project, and suggesting why in light of that project to become a teacher is an exalted concern. The methodology guiding the inquiry is largely hermeneutic, the purpose of the essay to interpret teaching from a Heideggerian perspective: its nature and general method. (shrink)

John Gray, much influenced by Isaiah Berlin and building on work by the late John Rees and the late Fred Berger, has recently stated three ‘fatal’ objections which virtually all analysts seem to find persuasive against John Stuart Mill's classic doctrine of liberty. First, Gray thinks it ‘an obvious objection to Mill's project that conceptions of harm vary with competing moral outlooks, so that no Principle of Liberty whose application turns on judgements about harm can expect to resolve disputes between (...) exponents of opposed moral perspectives’. Even if we overlook Mill's strange silence in the matter and supply him with a reasonable definition of harm, it remains clear that the liberty principle ‘is not, and cannot be, the very simple principle Mill sought’. For ‘Mill's principle is in its very nature radically incomplete. It tells us what we may not do, but not what we ought to do.’ To know when liberty should in fact be restrained, ‘we must look to other principles—chiefly the Principle of Utility itself’. But if general utility alone can ‘tell us how much liberty may be given up for how much harm-prevention’, then ‘there can be no question of adherence to [an] exceptionless principle such as Mill's Principle of Liberty’. Thus, even if we believe that Mill's version of utilitarianism is coherent, his judgements about the regulation of conduct must depend on a highly complex and controversial moral doctrine. (shrink)

Piers Norris Turner’s recent interpretation of John Stuart Mill’s philosophy transforms Mill into an illiberal utilitarian, against the textual evidence. Mill rejects Turner’s standard utilitarian, or “expansive,” conception of harm, according to which mere displeasure or distress counts as nonconsensual harm. Moreover, Mill is not a radical antipaternalist. He says that society may legitimately consider the individual’s own good as a reason for interference with other-regarding actions that inflict nonconsensual harm on others. But there are no reasons, paternalistic or otherwise, (...) for interference with self-regarding actions that may be displeasing to others without causing them any nonconsensual harm. (shrink)

This is a book about liberal democratic values and their implications for the design of political institutions. Its distinctive feature is the use of some simple mathematical techniques (known as social choice theory) to clarify and defend a rather complex utilitarian conception of the liberal democratic 'way of life' based on John Stuart Mill's work. More specifically, the text focuses on three well-known 'social choice paradoxes' which are commonly held to destroy any possibility of an ideal harmony among liberal democratic (...) values; and draws upon suggestions implicit in Mill's writings to develop an ethically appealing liberal democratic social choice framework in which the aforementioned paradoxes no longer cause concern. The revised framework is a rather complex version of utilitarianism and should be of special interest to welfare economists, social choice theorists, democratic political theorists and philosophers concerned with utilitarian ethics. Isaiah Berlin’s political thought consistently combines tragic value pluralism with moral priority for a minimum sphere of individual liberty which is defined and protected by a core set of basic human rights. His fundamental concept of a common moral minimum includes multiple components, including the idea that there is a common moral world of plural and conflicting incommensurable objective values and the idea that humans share a common nucleus of needs and interests centered on the overriding goal of human survival. (...) The basic human rights have priority over competing values because the rights are essential for human survival. They determine a common threshold of human decency: decent societies must respect the rights, which are in principle mutually harmonious under ordinary conditions, although emergencies can arise in which some of the rights must be sacrificed to respect others. Small wonder that those same words were later used to mythologize an Edenic Edwardian England poised on the brink of war, to preserve in aspic the fancy of a gilded innocence and order, and the promise of “blue remembered hills,”2 careless of the teeming, tumultuous reality of an England already in the shadow of the Tree of Knowledge. James’s masterpiece of 1881, The Portrait of a Lady, begins with a luxuriously redolent depiction of a summer afternoon, of the hours before dusk that constitute a pleasurable little eternity, of the languorous rhythms and rituals of what Disraeli called “the sustained splendour of [a] stately life.”3 Under certain circumstances there are few hours in life more agreeable than the hour dedicated to the ceremony known as afternoon tea. There are circumstances in which, whether you partake of the tea or not—some people of course never do,—the situation is in itself delightful. Those that I have in mind in beginning to unfold this simple history offered an admirable setting to an innocent pastime. The implements of the little feast had been disposed upon the lawn of an old English country-house, in what I should arion 27.1 spring/summer 2019 call the perfect middle of a splendid summer afternoon. Part of the afternoon had waned, but much of it was left, and what was left was of the finest and rarest quality. Real dusk would not arrive for many hours; but the flood of summer light had begun to ebb, the air had grown mellow, the shadows were long upon the smooth, dense turf. They lengthened slowly, however, and the scene expressed that sense of leisure still to come which is perhaps the chief source of one’s enjoyment of such a scene at such an hour. From five o’clock to eight is on certain occasions a little eternity; but on such an occasion as this the interval could be only an eternity of pleasure.4 This passage, it strikes me, is essentially Horatian in its Epicurean delight in the passing moment. For the Augustan poet Horace, this delight, which is intrinsically elegiac, is expressed in the sympotic pleasures of wine and friendship, in the freedom aestivam sermone benigno tendere noctem (“to prolong the summer night with genial conversation,” Epistles i.5.11). For Henry James, it rests in “the ceremony known as afternoon tea,” in the lengthening shadows on an English lawn by “the reedy, silvery Thames” (PL 32). In both cases the evanescence of these simple pleasures is deeply felt and pleasure itself heightened by an undertone of melancholy, by a nostalgic apprehension of the present. LOCI AMOENI in his review of Augustus J. C. Hare’s Days near Rome (1875), Henry James commented: “The smallest pretext for quoting from Horace—the most quotable of the ancients— should always be cultivated.”5 His own facility for quoting from Horace was evident from his earliest published works, and belied an “extraordinarily haphazard and promiscuous” education shuttling, at his father’s restless instigation, between New England, Britain and Continental Europe.6 James’s biographer, Leon Edel, recorded the family legend that William James (Henry’s Irish grandfather), “who was eighteen in 1789, when he set foot in the New World, 22 little eternities brought with him a ‘very small sum of money,’ a Latin grammar and a desire to visit the fresh battlefields of the Revolutionary War.”7 Young Henry’s instruction in Latin grammar seems to have begun in the Old World, under a private tutor in London in 1855, a Scotsman named Robert Thomson who later ran a small school in Edinburgh attended by Robert Louis Stevenson. Long-lasting interference effects in picture naming are induced when objects are presented in categorically related contexts in both continuous and blocked cyclic paradigms. Less consistent context effects have been reported when the task is changed to semantic classification. Experiment 1 confirmed the recent finding of cumulative facilitation in the continuous paradigm with living/non-living superordinate categorization. To avoid a potential confound involving participants responding with the identical superordinate category in related contexts in the blocked cyclic paradigm, we devised a novel set (...) of categorically related objects that also varied in terms of relative age – a core semantic type associated with the adjective word class across languages. Experiment 2 demonstrated the typical interference effect with these stimuli in basic level naming. In Experiment 3, using the identical blocked cyclic paradigm, we failed to observe semantic context effects when the same pictures were classified as younger–older. Overall, the results indicate the semantic context effects in the two paradigms do not share a common origin, with the effect in the continuous paradigm arising at the level of conceptual representations or in conceptual-to-lexical connections while the effect in the blocked cyclic paradigm most likely originates at a lexical level of representation. The implications of these findings for current accounts of long-lasting interference effects in spoken word production are discussed. (shrink)

I continue my argument that Millian qualitative superiorities are infinite superiorities: one pleasant feeling, or type of pleasant feeling, is qualitatively superior to another in Mill's sense if and only if even a bit of the superior is more pleasant (and thus more valuable) than any finite quantity of the inferior, however large. This gives rise to a hierarchy of higher and lower pleasures such that a reasonable hedonist always refuses to sacrifice a higher for a lower irrespective of the (...) finite amounts of each. Some indication of why this absolute refusal may be reasonable is provided in the course of outlining the content of the Millian hierarchy. It emerges that Mill's hedonistic utilitarianism has an extraordinary structure because it gives absolute priority over competing considerations to a code of justice that distributes equal rights and correlative duties for all. His utilitarianism also recognizes that certain aesthetic and spiritual pleasures may be qualitatively superior even to the pleasant feeling of security associated with the moral sentiment of justice. Thus, for instance, a noble individual may reasonably choose to waive his own rights so as to perform beautiful supererogatory actions that provide great benefits for others at the sacrifice of the right-holder's own vital interests. In an article published in Prolegomena 2006, Christoph Schmidt-Petri has defended his interpretation and attacked mine of Mill’s idea that higher kinds of pleasure are superior in quality to lower kinds, regardless of quantity. Millian qualitative superiorities as I understand them are infinite superiorities. In this paper, I clarify my interpretation and show how Schmidt-Petri has misrepresented it and ignored the obvious textual support for it. As a result, he fails to understand how genuine Millian qualitative superiorities determine the novel (...) structure of Mill’s pluralistic utilitarianism, in which a social code of justice that distributes equal rights and duties takes absolute priority over competing considerations. Schmidt-Petri’s own interpretation is a non-starter, because it does noteven recognize that Mill is talking about different kinds of pleasant feelings, such that the higher kinds are intrinsically more valuable than the lower. I conclude by outlining why my interpretation is free of any metaphysical commitment to the “essence” of pleasure. (shrink)
